On a day like today we need to remember all the victims of senseless killings. Like Reeva. The list is long. But unfortunately they are gone and we have to use their cases to reflect on our criminal and justice system. I would like a better legal system as a whole but what we have at the moment is what it is and all that we have. However, instead of just sitting in our couches following these cases, we really need to start holding accountable those who mess up these cases. The defence will always be the defence and it is the State's job to keep them in check. Judges are human and fallible and not inescapable of bias. But we cannot allow the likes of the SAPS/FSL, for example, not to follow SOPs (Standard Operating Procedures) and to then go to court as if nothing is wrong. Yes, they are also human but if a surgeon makes a mistake, you may well die. If investigating and forensic workers make a mistake, a killer may walk free and kill again – or justice is simply not served. They are getting paid by us the tax payers and must do their job properly, or get another job. They should not do their work for any " side" but for the court, so that the court can be best informed to make the right decision. Case after case we get silly but avoidable mistakes, which together with sometimes questionable judges and a by default a chance-taking defence team, too often leaves question marks over the judgement. Because of this the Van Breda case is moving far too close to a 50/50 vs what it could or should have been. (TM) (I will write a bit more about the current cases in due course, as I attended most days of both this year.)
